Can I keep my house if I file bankruptcy?

Are you behind in your mortgage payments? If you are and you can't get caught up before you file bankruptcy, you will have to file a Chapter 13 bankruptcy if you want to keep your house. If you are behind in your mortgage payments, Chapter 7 does not provide a way to catch up. Chapter 13 does provide a way.

If you are not behind in your mortgage payments, it is highly likely that you'll be able to keep your house in a Chapter 7 bankruptcy, if you live in the house. The homestead exemption protects most homes.
